When a Bank levies your funds,the levy is only for the particular day. The bank is required to remove whatever amount is available in your account that day, up to the amount of the IRS levy and send it to the IRS in 21 days. Getting that money back can be difficult but it can be done under certain circumstances.
A wage garnishment is a direct reduction to the IRS from you pay check and remains in effect until the IRS notifies the employer that the wage levy has been released. This can be handled but not easily. We would file and IRS Collection Appeal. There is a legal time frame for this and IRS guidelines to follow. The IRS issues nearly 4 million levy notices yearly. This is definitely a problem which needs to be addressed.
To start I file an IRS form 2848, Power of Attorney and inform the IRS of our intention to appeal. All collection action will then be put on hold as we prepare the appeal.
